LEGAL DEVELOPMENTS

Construction Law
Many new laws have gone into effect in the area of Construction law, in particular, new preliminary 20-day notices on private projects (Civil Code section 3097); The Contractor's right to stop work on non-payment; arbitration clauses with homeowners may no longer have secure "attorney fee provisions under Civil code section 1283.4; and the new Construction defect law." It is recommended that Construction prime contracts and subcontracts should be reviewed and revised periodically to keep up with these legal developments.

Human Resource Law
The new Worker's Compensation reforms should unshoulder businesess from excessive premiums and "no end in sight" claims. It is recommended that employment manuals be updated to incorporate key elements of the new reforms, including reference noting to employees that they will be expected to seek treatment from Workers Compensation insurance carriers' medical provider list. Also, the U.S. Supreme Court continues to affirm the existence of important employer defenses to harassment claims - meaning it remains key to train(and re-train) management under a clear written anti-harassment policy on how to prevent, recognize and address workplace situations early on before they become lawsuits.
